Terms and Conditions of Sale

Article 1 - Purpose and scope

These Terms and Conditions of Sale (the "Terms") govern the sale of services offered by Au Bavarois, operating the bar Au Bavarois, located at 36 avenue d'albigny (the "Seller" or "Au Bavarois"), to natural persons of legal age or aged at least 15 years with parental consent, acting as consumers (the "Customer").

Article 2 - Services offered

The Seller markets the following services:

2.1 VIP Membership (EUR 55 incl. tax for 12 months)

VIP membership gives the right, for 12 consecutive months from the date of payment validation:

The price can be paid in euros or in Bavarois Points (5,000 points) at the Customer's choice.

2.2 Locker reservation

Locker reservation is included in the VIP membership. No standalone locker sale is offered. Rental duration is aligned with the membership (12 months). A nominative invoice is issued upon payment validation (sequential numbering compliant with article 289 of the French General Tax Code).

2.3 Game tokens

Game tokens are sold only at the bar counter (no online sale). Current prices:

A token entitles to one game on electronic dart machines or one tournament participation (standard cost: 3 tokens per tournament, i.e. EUR 6). Tokens cover machine maintenance.

Article 3 - Prices

Prices are stated in euros, all taxes included. Au Bavarois currently benefits from the VAT franchise (article 293 B of the French General Tax Code); the mention "TVA non applicable - art. 293 B du CGI" appears on invoices. If legal thresholds are exceeded, the applicable VAT rate will appear distinctly on invoices.

The Seller reserves the right to modify prices at any time; services are billed on the basis of the price in force at the time of the order.

Article 4 - Order

4.1 VIP membership and locker

Orders may be placed:

The Customer provides their billing details (last name, first name, address, city, postal code, phone). These data are mandatory for issuing a compliant invoice. The order is confirmed after payment validation by the Seller.

4.2 Tokens

Tokens are handed over instantly at the counter against payment.

Article 5 - Payment terms

Accepted payment methods:

No payment by transfer, cheque, or online card is accepted at this date. Online VIP/locker orders must be finalised at the bar.

Article 6 - No right of withdrawal

The right of withdrawal provided for in articles L221-18 et seq. of the French Consumer Code applies only to contracts concluded at a distance or off-premises (Art. L221-1).

All services sold by Au Bavarois (VIP membership, locker, game tokens) are contracted, paid for, and activated physically at the bar counter, in the simultaneous presence of the Customer and the Seller. They are therefore on-premises sales, NOT subject to the right of withdrawal.

Consequently, no withdrawal or automatic refund can be required by the Customer after payment validation at the counter. Any refunds fall under the legal warranty of conformity (Article 7 below) or a commercial gesture by the Seller, at its sole discretion.

Article 7 - Legal warranties

The Seller is bound by the legal warranty of conformity (articles L217-3 et seq. of the French Consumer Code) and by the warranty against hidden defects (articles 1641 et seq. of the French Civil Code) for the services marketed.

The Customer may invoke these warranties by contacting the Seller at aubavarois@gmail.com or by mail at the registered office.

Article 8 - Personal data

Data collected at the time of an order are processed in compliance with the General Data Protection Regulation (GDPR) and the French Data Protection Act. Processing terms are described in the Privacy Policy, accessible from the site footer.

Billing data (civil name, address, phone) are kept for ten (10) years from the close of the accounting year during which the invoice was issued, in accordance with article L123-22 of the French Commercial Code.

Article 9 - Complaints and consumer mediation

9.1 Complaints

Any complaint must be addressed first to the Seller:

The Seller undertakes to acknowledge receipt within 7 days and to provide a response within 30 days.

9.2 Consumer mediation

In accordance with article L612-1 of the French Consumer Code, the Customer may, in case of unresolved dispute, freely use a consumer mediator.

The consumer mediator designated for Au Bavarois is the one provided by the professional union to which the Seller belongs (HCR - Hotels, Cafes, Restaurants branch).

Note: the exact mediator details will be published as soon as the HCR union communicates them. In the meantime, any complaint may be sent directly to the Seller (see 9.1).

9.3 European Online Dispute Resolution platform

For cross-border disputes, the Customer can access the European Commission ODR platform: https://ec.europa.eu/consumers/odr/

Article 10 - Disputes and applicable law

These Terms are governed by French law.

In case of dispute brought before the courts, the consumer Customer has the option, in accordance with article R631-3 of the French Consumer Code, to seize at their choice the court of the place where they resided at the time of conclusion of the contract or of the harmful event, or the court of the place of establishment of the Seller (Annecy). The French version is authoritative.
